B. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize Black Press and blackpress.tv to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Use.

Please don’t abuse the site. Everything we do with blackpress.tv and BCLocalNews.com involves a level of trust. We trust you to be responsible, and our users respect that trust.
Here are some common-sense rules to ensure everyone enjoys our sites:blackpress.tv is not for pornography or sexually explicit content. If this describes your video, even if it’s a video of yourself, we don’t want it. There are exceptions for educational, documentary and scientific content, but only if that is the sole purpose of the video and it is not gratuitously graphic. Be advised we work closely with law enforcement and will report child exploitation.

• Don’t post videos showing offensive or inappropriate content like animal abuse, drug abuse, under-age drinking and smoking, dangerous acts with an inherent risk of physical harm, or criminal activity.
• Graphic or gratuitous violence is not allowed.
• Respect copyright. Only upload videos you made or you are authorized to use. Don’t upload content someone else owns the copyright to, such as music tracks, snippets of copyrighted programs, or videos made by other users, without necessary authorizations.
• We encourage free speech and defend everyone’s right to express unpopular points of view. But we don’t tolerate hate speech (which attacks or demeans a group based on race, religion, disability, gender, age, and sexual orientation/gender identity).
• Things like predatory behavior, stalking, threats, harassment, intimidation, invading privacy, revealing other people’s personal information, and inciting others to commit violent acts or to violate the Terms of Use are taken seriously. Anyone caught doing these things will be permanently banned.
• Don’t create misleading descriptions, tags, titles or thumbnails to increase views. Posting large amounts of unwanted or repetitive content, including comments and private messages, is unwelcome.
• Videos involving children (anyone younger than 18 years) are sensitive. Videos containing children should never be sexually suggestive or violent. If you’re sharing a private moment or home movie, consider making it a private video only your family and friends can see. Never post videos of children without their parents’ awareness and consent.

Copyright
For clarity, you retain all copyright and ownership rights to your User Submissions, subject to the following. By submitting User Submissions to blackpress.tv, you hereby grant Black Press Ltd. a worldwide, perpetual, non-exclusive, royalty-free, sublicenseable, assignable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions, including without limitation for promoting and redistributing part or all of the blackpress.tv Website (and derivative works thereof) in any media formats and through any media channels. You also grant users of blackpress.tv a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions for non-commercial purposes of research, private study, education, parody or satire, and in any manner permitted through the functionality of the Website and under these Terms of Use. The above licenses granted by you in respect of User Submissions are all perpetual and irrevocable.

Choice of Law and Forum
These Terms of Use are agreed to be governed by the law of British Columbia, Canada, and disputes are agreed to be adjudicated in that jurisdiction.

Arbitration
All disputes between you as User and Black Press Ltd. as owner and operator of blackpress.tv Website and BCLocalNews.com respecting the meaning and effect of these Terms of Use and their application shall be submitted to arbitration pursuant to legislation governing commercial arbitration in the appropriate jurisdiction. If you as user do not have resources to pursue arbitration that you otherwise wish to pursue, you may apply, and Black Press will entertain paying the cost of arbitration, in the first instance, subject to the arbitrator's rulings on costs. It is agreed that, in light of submission to arbitration, that you as User, in common with all other Users, agree not to have recourse to the Class Proceedings Act or any other class action remedy
